These Terms govern your use of the Fairbairn Constructions Pty Ltd (Fairbairn, we, us or our) website. By using this website, you agree to these Terms. If you do not agree, please do not use the website.

Website information only

The website provides general information about Fairbairn, its experience, projects and available construction and consulting services. Website content is not advice tailored to your property, plans, budget or circumstances and should not be used as a substitute for appropriate project-specific, legal, financial, engineering, architectural, planning, certification or other professional advice.

Submitting an enquiry, requesting a discussion or receiving an initial response does not create a client, builder, consultant or other contractual relationship. Any services will be subject to Fairbairn accepting the engagement and, where required, a separate written proposal, scope or contract.

Construction and consulting information

Construction outcomes, timeframes, costs and buildability depend on matters including site conditions, existing building fabric, access, design documentation, approvals, consultant input, product availability, market conditions and the final agreed scope.

Unless expressly stated in a separate written engagement:

  • website information is not a quotation, fixed price or guaranteed construction cost;
  • cost observations and estimates are indicative only and may change as information and scope develop;
  • consulting information is practical building guidance, not certification, quantity surveying, engineering, architectural, legal or financial advice;
  • no representation is made that a project will obtain approval, meet a particular budget or be completed within a particular timeframe; and
  • you remain responsible for obtaining the professional advice, approvals and documentation required for your project.

A later written agreement for construction or consulting services will govern those services. If these website Terms are inconsistent with that agreement, the agreement applies to the extent of the inconsistency.

Consumer and statutory rights

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory warranty or other right or remedy that cannot lawfully be excluded, including rights that may arise under the Australian Consumer Law or the Home Building Act 1989 (NSW).

Where Fairbairn supplies services to a consumer, those services come with guarantees that cannot be excluded under the Australian Consumer Law. Applicable statutory warranties for residential building work are not limited by these website Terms.

Accuracy and availability

We take reasonable care when preparing website content, but information may be incomplete, become outdated or contain errors. To the extent permitted by law, we do not warrant that the website will always be available, uninterrupted, secure or free from errors or harmful components.

Project descriptions and photographs are illustrative. Each project has different conditions and requirements, and previous work does not guarantee the same design, cost, timeframe or outcome for another project.

Information collected through the website

The enquiry form collects your name, email address and project details, together with any phone number, suburb or service selection you choose to provide. Enquiries are sent to our business email address and the custom form does not create a separate enquiry record in the WordPress database.

Our website and hosting provider may also record standard technical information such as IP address, browser and device type, requested pages, access times, referring addresses, and security or diagnostic events.

The public website does not currently accept payments or file uploads, provide public user accounts, collect newsletter subscriptions, or use third-party website analytics, advertising pixels or behavioural advertising. Intellectual property

Unless otherwise stated, website text, branding, graphics, layout and other original content are owned by or licensed to Fairbairn and are protected by applicable intellectual property laws. Project photographs may also be owned by clients, photographers, architects or other licensors.

You may view and temporarily download website content for personal, non-commercial reference. You must not reproduce, republish, modify, distribute, sell, frame or commercially exploit website content without permission from the relevant rights holder, except as permitted by law.

Acceptable use

You must not use the website to:

  • break any law or infringe another person’s rights;
  • submit false, misleading, unlawful, confidential or harmful material;
  • introduce malicious code, interfere with security or disrupt the website;
  • attempt to gain unauthorised access to the website, server or connected systems; or
  • collect information from the website through automated means in a way that places an unreasonable load on the service.

Third-party websites

The website may link to third-party websites for convenience or further information. We do not control those websites and are not responsible for their content, availability, security or privacy practices. A link does not necessarily indicate endorsement.

Liability for website use

To the maximum extent permitted by law, Fairbairn is not responsible for loss arising solely from reliance on general website information, inability to access the website, or use of a third-party website. This limitation does not apply to liability that cannot lawfully be excluded or limited, and does not alter any rights arising under an accepted proposal or contract.

Changes to these Terms

We may update these Terms when the website, our services or applicable requirements change. The effective date above identifies the current version. Your continued use of the website after an update is subject to the revised Terms.

Governing law and contact

These Terms are governed by the laws of New South Wales and applicable Commonwealth laws of Australia. Nothing in this clause prevents you from relying on rights you have under applicable law.
